Send Copy A to the SSA; Copy 1, if required, to your state, metropolis, or local tax division; and Copies B, C, and 2 to your employee. Keep a duplicate of Copy A, and a duplicate of Form W-3, together with your records for a minimal of four years. If you willfully file a fraudulent Form W-2 for funds that you declare you made to a different individual, that person might find a way to sue you for damages. If you’re found liable, you may have to pay $5,000 or more in damages. $120 per Form W-2 when you correctly file more than 30 days after the due date however by August 1; the maximum penalty is $1,891,500 per year ($630,500 for small businesses).
